In this paper the A. describes the institutional organisation adopted by the Italic populations during the bellum Italicum/bellum Marsicum/bellum sociale (91-88 a.C.), focusing on the similarities and differences with the organisation of the Roman Republic and on the strong ethnical boundaries between the Italic peoples, an aspect that we can see from the coin issues. For the causes of the outbreak of the conflict the A. points to Appian, who told us that the main reason for the hostilities was the refusal by Rome to extend the civitas Romana to its Italic socii (App. BC 1.18-19; 21; 23; 34-36) [pp. 52-53]. The A. also reflects on the terminology used by the Greek historian to describe the political and military structure of the Italians during the war (e.g. App. BC 1.38; 39; 40) [pp. 54-55]. For a deeper understanding of the institutional layout utilized by the Italic communities the A. refers to Diodorus Siculus and Strabo. In fact, in the Biblioteca Historica, Diodorus dedicated a good part of his narration to what he called the Μαρσικὸς πόλεμος (Diod 37.2.4-7): Diodorus indicates the choice of Corfinum as the κοινὴ πόλις of the allies and the existence of a representative assembly of 500 men and of some magistrates specular to the Romans such as two consules/ὕπατοι and twelve praetores/στρατηγοί [pp. 55-56]. Strabo, meanwhile, presents us less information and his passage can be seen as a simple excursus about the Apennine communities (Strab. Geog 5.4.2) [p. 57]. After the presentation of these sources the A. concentrates the attention on the notions taken from Diodorus, such as the existence of a permanent council of 500 men from all the Italic communities (σύγκλητος), the keystone of the Italic state, from which the nine αὐτοκράτορες mentioned by Appian would be elected [p. 59]. For the A. this council represents a difference from the Roman senate, due to its representative nature, therefore the thesis of an institutional layout specular to the Roman state, as expressed by Diodorus, it isn’t to take as face value [p. 59]. In contrast the A. indicates a strong similarity in the magistrates in charge of the war of this new-born Italic state. As we can find in epigraphical and numismatical evidence (e.g. CIL IX, 6086; ILLRP 1089; EDR125410; ImIt Aufidena 1), there was an overlay in the names, number and functions of the magistrates: two consules/ὕπατοι/kúsúl, twelve praetores/στρατηγοί and we can find also the title imperator translated in Oscan embratur [pp. 59-62]. The A. finds other information for a reconstruction of the Italic state in some epigraphical sources from the city of Pompeii related to the military organization (e.g. ImIt Pompei 5) [p. 63], and in bronze tablets (ImIt Italia (?) 2 and 7, Bari; ImIt Italia (?) 3-6; 8-9, Torino, probably used for the selection of military officers [pp. 64-66]. Finally the A. reflects over the nature of what she thinks was a true Italic state, an alternative to the Roman Republic and with institutions created to last over time. This aspect is proved by the coin issues, that expressed the legitimacy of the Italic populations’ new state. Moreover, the symbols communicated through these coins were a statement of ethnic and political identity: e.g. the image of the bull (HNItaly no. 422), the personified Italia (HNItaly no. 422), the oath of the soldiers (HNItaly no. 415) and the Dioscuri (HNItaly no. 422 and 426). The A. stresses out the importance of the Dioscuri, and states, in contrast with M.H.Crawford, that their presence on these coins would be a message of allegiance between the various Italic ethnic groups [pp. 68-70]. As for the iconography with the bull it can be seen as a common Italic symbol, connected on the one hand to the origin of the name Italia/Viteliú [pp. 70-72], and on the other hand to a sacred animal to the Oscan-speaking people, which was the core of the new Italic state [pp. 64-70]. L’A. raccoglie e discute le interpretazioni del significato assunto dalla statua del satiro Marsia posta all’interno del foro romano, un tema su cui la critica contemporanea non ha ancora raggiunto una posizione univoca. La prima testimonianza presa in esame dall’A. è una moneta degli anni Ottanta del I sec. a.C. (RRC 363) raffigurante al diritto Apollo laureato ed al rovescio la statua di Marsia, affiancata da una colonna e dal nome di L. Marcius Censorinus [pp. 51-55], che rinvierebbe ad un legame tra Marsia e la gens dei Marcii. L’A. passa poi ad esaminare fonti letterarie di età successiva in cui viene fatto esplicito riferimento alla statua del satiro a Roma, e.g. nelle Satire di Orazio (Sat. 1.6.119-121) e nei rispettivi commentatori (Pseudo-Acrone e Porfirione) [pp. 56-57], in Plinio il Vecchio (HN 21.8-9) e in Seneca (Ben. 6.32.1). In Servio (Aen. 3.20) emerge invece un legame particolare tra la figura di Marsia ed il concetto di libertas, poiché suo patrono è Liber Pater e poiché il suo stesso simulacro è un simbolo di libertà “nelle città libere”, un concetto che ritroviamo anche in Macrobio (Sat. 3.12) [pp. 57-58]. L’A. riflette quindi su una versione del mito (e.g. in Sil. Pun. 8.502-504), in cui il satiro scampò alla morte, trovando rifugio in Italia e dando il suo nome alla popolazione dei Marsi, le cui note capacità augurali costituivano del resto per gli antichi un ulteriore nesso tra questo popolo e Marsia; interessante è il fatto che sia la moneta di Marcius Censorinus sia parte della tradizione letteraria relativa al nesso Marsia-Marsi, potrebbero rinviare alle sorti di Marsi e Italici durante e dopo la Guerra Sociale [pp. 59-62]. Altri spunti di riflessione sono offerti all’A. dall’iconografia presente negli anaglypha Traiani di II sec. d.C., in cui la statua di Marsia è rappresentata nei pressi di un albero, il ficus Ruminalis; tale vicinanza spaziale, nel foro romano, potrebbe rinviare ad un ruolo del simulacro connesso all’amministrazione della giustizia e in generale alla sfera della legalità, connessione già presente in Orazio [pp. 61-63]. Nelle pagine conclusive l’A. torna nuovamente ad occuparsi del legame tra la figura di Marsia, il suo nesso con la libertas e con le civitates liberae emerso dai testi di Servio e Macrobio e la presenza di statue del satiro, attestata in epigrafi e monete di età imperiale, in ca. una quarantina di città provinciali, prevalentemente di status coloniale [pp. 64-68]. Im Mittelpunkt des Artikels steht der Bundesgenossenkrieg und wie das daraus resultierende neue Bürgerrecht dazu betrug, das Reich über so viele Jahrhunderte in einem stabilen Gleichgewicht zu halten. Das römische Bürgerrecht definiert sich durch die Aufnahme in die Bürgerlisten und durch die Anerkennung durch die römischen Magistrate in juristischen und bürgerrechtlichen Verfahren. Als entscheidend für das Funktionieren der Gesellschaft und des politischen Gleichgewichts sieht der A. aber die Partizipation und den Einbezug der Tausenden neuen Bürger, die nach dem Bundesgenossenkrieg zu erfolgen hatte. Zuerst geht der A. auf die historische Entwicklung der Gewährung des römischen Bürgerrechtes ein, die durch drei aufeinanderfolgende Gesetze erfolgte: die lex Calpurnia im Jahre 90 v. Chr., die Generälen erlaubte, das Bürgerrecht an verbündete Städte Roms zu verleihen, dann die lex Iulia Ende des Jahres 90, die jenen Städten das Bürgerrecht gewährte, die nicht rebelliert hatten und schlussendlich die lex Plautia Papiria von 89 v. Chr., die das Bürgerrecht an alle Bürger verlieh, die ihren Wohnsitz in Italien hatten [p. 36]. Die neuen Gemeinden wurden als Munizipien nach römischem Vorbild organisiert, versehen mit einem in Rom verabschiedeten Stadtgesetz (lex data, z.B. die lex von Tarent). Die Gesetze glichen einander größtenteils und variierten etwa in Bezug auf lokale Traditionen, weshalb laut A. auch die Oberschicht der jeweiligen Gemeinde im Prozess der Stadtgesetzgebung involviert gewesen sein musste. Die Munizipalisierung erfolgte vor allem unter der Dominanz großer Persönlichkeiten wie Cäsar und Sulla, deren Anhänger als Gründer und Patrone der neu gegründeten Munizipien fungierten und etwa römische Bauwerke spendeten [p. 38]. In Rom selbst führte die enorm gesteigerte Bürgerzahl (von 400.000 in 114 v. Chr. auf 910.000 in 70 v. Chr.) zu einem institutionellen Wandel: Viele wichtige bürgerrechtliche Angelegenheiten wie z.B. der Zensus konnten nicht mehr in Rom durchgeführt werden, sondern wurden, wie uns die Tabula Heracleensis (CIL I, 593 bzw. M.H.Crawford (ed.), Roman Statutes, I, London, 1996, 355-391, nr. 24) zeigt, in der jeweiligen Gemeinde vor Ort erledigt. Auch auf die Politik und die Wahlen in Rom nahmen die neuen Bürgerschichten Einfluss, wie etwa Quintus Cicero in seinem Commentariolum Petitionis beschreibt [p. 39]. Wie der A. anmerkt, entstand so eine Art Doppelbürgerschaft, welche die starke lokale Identität der jeweiligen Provinzeliten mit dem angesehenen Bürgerrecht der römischen Herrscher verband und das Reich jahrhundertelang stabilisieren sollte. Den Schlussteil seines Artikels widmet der A. der Demokratie-Debatte. Der A. kritisiert den laut seiner Aussage „simplen Zugang“ zur Materie, die etwa der britische Historiker Fergus Millar an den Tag legte, indem er anachronistische Konzepte wie jenes der modernen Demokratie auf das römische Gemeinwesen anwandte. Nichts deutet darauf hin, dass das Volk mithilfe der Wahlen und contiones ein wesentlicher Antreiber der politischen Vorgänge in Rom gewesen sein könnte. Vielmehr schätzt der A. den wissenschaftlichen Zugang der deutschen Forschung, ausgehend von Ch.Meier und fortgeführt durch seine Kollegen wie Flaig, Hölkeskamp oder Jehne, die in dem Element der Volkspartizipation eher ein Instrument der Legitimation der Magistrate als ein politisches Entscheidungsinstrument sehen [pp. 42-43]. Politisch organisiert war die Bevölkerung in verschiedenen Gruppen, etwa wie in vici und tribus, aber vermehrt spielten auch andere Gruppen wie die Berufskollegien oder die Gruppe der Getreide-Empfänger als politisierte Masse eine Rolle – ein Umstand, den vor allem „Populisten“ wie Clodius Pulcher für ihre Zwecke auszunutzen suchten. Nicht das römische Klientelsystem, so der A., war für die Mobilisierung der Massen geeignet, sondern die Herstellung von Abhängigkeitsverhältnissen, wie sie in großem Maße bei Gründungen von Kolonien und Munizipien, bei den Kollegien oder den Getreideverteilungen geschaffen werden konnten [pp. 44-45]. Wie der A. zu Schluss anmerkt, spielte die Munizipalaristokratie während der Bürgerkriege noch keine so entscheidende Rolle, sehr wohl aber nach Etablierung des Prinzipats. Die stabilisierende Rolle wurde begünstigt durch das neue Bürgerrecht, das die Ausübung der Bürgeraufgaben nicht mehr an die Stadt Rom band und so zu deren direkten Umsetzung durch die neuen Bürger in den Munizipien und Kolonien Italiens führte [p.48]. Die Problematik der Aufteilung der neuen Bürger auf die römischen Tribus muss laut A. schon in der lex Iulia von 90 v. Chr. eine Rolle gespielt haben. Obwohl wir von der lex Iulia selbst keine Belege haben, scheinen bereits senatus consulta aus dem vorigen Jahrhundert darauf hinzudeuten, dass es als römischer Bürger unerlässlich war, auch zu einer Tribus gehört zu haben [p. 98]. Der A. gibt eine Auflistung aller Tribus, geordnet nach geographischen Kriterien, nämlich den aus Rom wegführenden Hauptstraßen (Ostiensis, Appia, Latina, Praenestina, Valeria, Salaria, Flaminia, Clodia), und welche neuen Gemeinden ihnen zugewiesen wurden, wobei er aufständische von zu Rom loyalen Gemeinden unterscheidet [p. 99]. Demnach liegt die Vermutung nahe, dass die Römer die aufständischen Gemeinden auf die verschiedenen Gruppen aufteilten, sodass jede geographische Region eine oder zwei Tribus mit ehemaligen Rebellen besaß. Da die Aushebung von Truppen zu dieser Zeit nicht mehr nach Tribus, sondern nach Regionen durchgeführt wurde, fanden sich ehemalige Rebellen bei der Rekrutierung somit nun Seite an Seite mit treuen Verbündeten Roms [p. 100]. Zu Schluss geht der A. auf ein Problem ein, das sich durch unterschiedliche Kommentare von Appian und Velleius zur Tribuseinteilung durch die lex Iulia ergibt. Appian (BC 1, 213) erwähnt, nachdem er die Bestimmungen der lex Iulia selbst überspringt, dass für die neuen Bürgern, je nachdem wie viele in Rom zu einer Wahl erschienen, ad hoc Tribus geschaffen wurden, die nach den 35 normalen Tribus abstimmen durften (und daher keine politische Rolle spielten). Velleius (2, 20, 2) hingegen sagt, dass die neuen Bürgern auf acht Tribus aufgeteilt wurden, damit sie nicht zu viel Macht bekämen. Der A. schlägt daher vor, dass Appian sich auf die krisenhafte Situation bezog, als vom Gesetzgeber der lex Iulia vorerst vorgesehen war, dass man Bürgern, die noch nicht vom Zensus erfasst worden waren, eine Möglichkeit gab, mitabzustimmen, indem man ad hoc Tribus für diese Bürger schuf. Diese gut gemeinte Bestimmung führte jedoch zu den Unruhen infolge deren P. Sulpicius Rufus die neuen Bürger in Rom bei der Wahl in den existierenden Tribus abstimmen ließ. Velleius wiederum könnte sich auf die Verteilung der rebellierenden Gemeinden 87 v. Chr. auf die 8 Tribus beziehen, die auf die Regionen gleichmäßig aufgeteilt waren. [N. Rafetseder]

Der A. beschäftigt sich in seinem Artikel mit dem beim Cicero-Kommentator Asconius (Ascon. in Cic. Pis. 3,11f.) erwähnten ius civitatis per magistratum adipiscendae (Gewährung des römischen Bürgerrechtes für Magistrate latinischer Gemeinden) und seiner Deutung durch die Forschung. Durch die Emendation einer Korruptel dieser Textstelle möchte der A. zu einer präziseren Interpretation dieser Stelle kommen. Der A. tritt dafür ein, dass das ius civitatis per magistratum adipiscendae für Latiner-Städte bereits im Zeitalter der Gracchen 125/122 v. Chr. eingeführt worden ist. Als Terminus ad quem sieht der A. die lex Acilia repetundarum von 123/121 v. Chr., die Ädilen und Prätoren (und in der vorhergehenden Textlücke wohl auch consules und IIviri) latinischer Gemeinden von der Gewährung der provocatio im Erfolgsfalle der Klage ausnahm, da sie dieses Recht bzw. das dieses Recht beinhaltende römische Bürgerrecht bereits durch die Ausübung eines Amtes besessen haben müssen [pp. 226-227]. Der A. widmet sich nun der Präzisierung dieses Rechtes: Gaius definiert für latinische Gemeinden im 2. Jh. n. Chr. zwei verschiedene Status: Im Fall des von Hadrian geschaffenen Latium maius genügte der Eintritt in den Gemeinderat für die Erlangung des Bürgerrechtes, im Fall des Latium minus musste ein öffentliches Amt übernommen werden (Gai. Inst. 1,95f). Während einige Quellen (App. BC 2,26 (98), Strab. 4,1,12) ungenau einen Automatismus und eine Gleichzeitigkeit zwischen Magistratsausübung und Bürgerrechtsgewährung wiedergeben, kann man mithilfe von Cicero und der lex Irnitana Klarheit gewinnen. Laut ersterem gab es weder ein doppeltes Bürgerrecht noch einen Bürgerrechtsverlust ohne die Zustimmung des Betroffenen (sprich einen Automatismus), das flavische Stadtrecht von Irni wiederum gewährt jedem beliebigen Magistrat nach Ausübung des Amtes das römische Bürgerrecht. Der A. kommt zum Schluss, dass für die spätrepublikanische Phase sowohl der cursus honorum als auch die Unmöglichkeit einer doppelten Staatsbürgerrecht beim ius civitatis per magistratum adipiscendae eine Rolle gespielt haben müssen. Ein decurio konnte demnach laut A. nach der Bekleidung einer Magistratur für die er als Voraussetzung ratsfähig sein musste (was für die Quästur zu dieser Zeit nicht zwingend gelten musste, sie führte auch etwa im vorsullanischem Rom nicht automatisch zu einem Senatssitz) entscheiden zwischen der civitas Romana oder der provocatio ad populum Romanum, wobei er hier sein Bürgerrecht behalten und eine lokale Karriere weiterverfolgen konnte (pp.228-233). Nach diesen Darlegungen versucht der A. eine Neudeutung der Asconius Stelle „†peti† magistratus civitatem adipiscerentur“, wobei er petitione magistratus statt den bereits formulierten Verbesserungen petenti/petendo/per/gerendo magistratus vorschlägt. Der latinische Magistrat konnte demnach auf Antrag (etwa bei Konsul oder Prätor) das römische Bürgerrecht beantragen, ansonsten behielt er das ius provocationis und sein lokales Bürgerrecht. Erst unter augusteischer Zeit wurde eine Doppelstaatsbürgerschaft möglich und diese Regelung demnach obsolet [pp. 233-238]. [N. Rafetseder]

Nella prima metà del II sec.a.C. si registra secondo l’A. un triplice fenomeno migratorio: gli Italici verso le colonie latine (esempi di Fregellae e Isernia) nella posizione di incolae, i Latini verso Roma, e le deportazioni di massa per ripopolare le zone appenniniche, sull’esempio dei Ligures Baebiani [pp. 177-188]. La migrazione massiccia di Sanniti e Peligni a Fregellae coincide con la profonda ristrutturazione dei quartieri residenziali cittadini, dove si introducono installazioni industriali, spec. fullonicae, come provano gli scavi condotti nel centro [pp. 180-182]. La profonda trasformazione etnica (sannitizzazione) e socio/economica (città manifatturiera) subita da Fregellae sino al 125 a.C. avrebbe creato da un lato un terreno favorevole alla ribellione e dall’altro spiegherebbe la brutalità della reazione romana nei confronti di quella che era stata una delle più importanti e fedeli colonie latine (fondata nel 328 a.C.) [pp. 183-184]. A Fregellae sfruttamento e lavorazione del ferro dei monti della Meta ed i prodotti venduti sul mercato di Minturnae. Coinvolgimento della famiglia di Cicerone nella manifattura delle lane. Helvia, la madre di Cicerone, ha un nome di origine sabellica, e potrebbe appartenere alle famiglie italiche emigrate a Fregellae prima del 177 a.C. [p. 185]. [L. Cappelletti]

L’A. propone una rassegna critica di tutte le fonti letterarie rilevanti per la definizione e la conoscenza dell’istituto del fundus fieri e del regime dei populi fundi facti. Sui passi ciceroniani nella pro Balbo e loro (ri)valutazione per la definizione dell’istituto. Il dato essenziale dell’istituto consiste nell’accettazione espressa da parte di popoli non romani di una lex populi Romani, accettazione che determina due applicazioni pratiche fondamentali: volontà di recepire una singola legge oppure volontà di voler fruire di un vantaggio (commodum/beneficium) offerto da una legge romana [pp. 2-7]. Sull’espressione populus fundus factus in Gell. NA 16.13.6, nell’ambito della definizione di municipes e municipium risalente molto probabilmente all’imperatore Adriano. Il valore tecnico-giuridico di fundus fieri rispetto ad una lex è confermato anche in Gell. NA 19.8.12, seppure in contesto metaforico [pp. 7-10]. L’espressione fundus esse in Plauto Trin. vv. 1122-1123, rinvia all’idea dell’accettazione, nello specifico di un impegno altrui [pp. 10-11]. L’esistenza di una locuzione tecnica populus fundus è confermata da Paolo-Festo, s.v. fundus, 79 L., ma nel suo complesso il testo è confuso e non è utilizzabile per la comprensione dell’istituto [pp. 12-13]. Argomentazioni dell’A. contro l’etimologia di fundus da *fendere = “legare” proposta da G. Beseler [pp. 14-17]. Ammessa la connessione con l’istituto del fundus fieri delle espressioni municipia fundana/municipes fundani nella Tavola di Heraclea (ll. 159ss.). Si tratterebbe di municipi che si fanno fundi, che accettano cioè, una qualsiasi legge (e quindi non solo quella de civitate) elaborata da Roma [pp. 18-24]. [L. Cappelletti]
